TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions of Service ("TCS") govern the relationship between FamilyPro (hereinafter "We" or "FamilyPro") and its clients, whether individuals (B2C) or businesses (B2B). By using our services, the client (hereinafter "You") fully and unconditionally accepts these terms.

SECTION 1: TERMS AND CONDITIONS FOR INDIVIDUALS (B2C)

1. Purpose
FamilyPro offers individuals recruitment and administrative management services for household staff contracts.

2. Services and Obligations

  • Connecting clients with candidates for household staff positions (nannies, caregivers, housekeepers, etc.).

  • Selecting and presenting profiles that match your needs.

  • Administrative management of employment contracts and legal obligations.

  • Providing advice and support in hiring and managing staff.

3. Satisfaction Guarantee

  • If the hired employee does not meet the family's expectations within 4 weeks of hiring, FamilyPro agrees to propose a replacement at no additional cost, provided there is a justified reason.

  • If the employee leaves their position voluntarily within 4 weeks of hiring, FamilyPro also agrees to propose a replacement at no additional cost.

  • This guarantee applies only if the client complies with their contractual and legal obligations.

  • In the event of unavailability of a replacement within a reasonable period, FamilyPro may offer a partial refund of the recruitment fees.

4. Rates and Payment Terms

  • Services are billed according to a quote established in advance and accepted by the client.

  • Payment is due upon signing the service contract.

5. Responsibilities

  • FamilyPro is committed to selecting qualified candidates but cannot guarantee the performance or continuity of the employment relationship between the client and the selected candidate.

  • The client remains responsible for compliance with the legal and contractual obligations related to the hiring process.

6. Confidentiality

  • Information exchanged during the services remains strictly confidential.

  • FamilyPro agrees not to disclose personal information of clients or candidates without their consent.

7. Termination and Cancellation Terms

  • Any request for cancellation or termination must be submitted in writing.

  • Cancellation fees may apply depending on the progress of the service.

SECTION 2: TERMS AND CONDITIONS FOR BUSINESSES (B2B)

1. Purpose
FamilyPro provides businesses with services aimed at improving the well-being of their employees through a range of offerings tailored to their personal and family needs.

2. Services and Obligations

  • Recruitment and administrative management of household staff for employees of partner companies.

  • Assistance in finding childcare solutions (daycares, schools, babysitters, etc.).

  • Support for employees' elderly parents (home assistance and care services).

  • Services related to household maintenance and concierge services to make employees' daily lives easier.

  • Advice and support in contracting and managing domestic services.

3. Rates and Payment Terms

  • Services are billed according to a quote established in advance and accepted by the client company.

  • Specific terms may be negotiated depending on service volume and contractual commitments.

4. Responsibilities

  • FamilyPro is committed to providing quality services and supporting companies in enhancing the well-being of their employees.

  • The client company remains responsible for ensuring compliance with the legal and contractual obligations related to services provided to its employees.

5. Confidentiality

  • All information exchanged in connection with the services remains strictly confidential.

  • FamilyPro agrees not to disclose personal information of clients or employees without their consent.

6. Termination and Cancellation Terms

  • Any request for cancellation or termination must be submitted in writing.

  • Cancellation fees may apply depending on the progress of the service.

GENERAL PROVISIONS

GENERAL PROVISIONS

1. Applicable Law and Disputes

  • These TCS are governed by Swiss law.

  • In the event of a dispute, the parties agree to attempt an amicable resolution before any legal action.

2. Modification of Terms and Conditions

  • FamilyPro reserves the right to modify these TCS at any time. Any modification will be communicated to the affected clients.

3. Official Language

  • Please note: The official version of these Terms and Conditions is in French. In case of any discrepancy between the French and English versions, the French version shall prevail.
